Telangana High Court upholds validity of Press and Registration of Books Act provisions


The Court stated that Article 19(1)(a), or the right to freedom speech and expression, is subject to regulation. It is not unreasonable to expect that you will be able to afford restrictions.

The Parliament has attempted by enacting Sections 5, 6 and 7 of the Act to regulate newspaper publishing, which is reasonable restriction,” the bench ruled.

The petitioners were assured that their fundamental rights under Article 19(1) (a) of India’s Constitution are not violated.

The Court decided that the petitioners could not refute the presumption as to the constitutional validity and therefore dismissed the complaint.
